Rental agreement

1. 1. बहालमा दिइएको घर

   घरधनीले देहायको घर बहालवालालाई बसोबास प्रयोजनका लागि बहालमा दिएको छ:

   1. The property

   The Landlord lets the following house to the Tenant for residential use:

   • Rooms: 4 bedrooms, 1 kitchen, 3 bathrooms, 2 living rooms
   • Furnishing: fully furnished
   • Parking: 2 cars
   • Included: Municipal water (Khanepani), Boring / deep well, Inverter / power backup, Garden, Security guard, Fibre internet

2. 2. बहाल अवधि

   यो सम्झौता 2083 कात्तिक 11 गते (28 अक्टोबर 2026) देखि 2084 कात्तिक 10 गते (26 अक्टोबर 2027) सम्म 1 वर्षको लागि हुनेछ। अवधि सकिएपछि दुवै पक्षको लिखित सहमतिमा नवीकरण गर्न सकिनेछ। बसोबासका लागि एक पटकमा बढीमा 5 वर्षको सम्झौता हुन्छ (दफा 385)।

   2. Term

   This agreement runs for 1 year, from 11 Kartik 2083 BS (28 Oct 2026) to 10 Kartik 2084 BS (26 Oct 2027). When it ends it may be renewed if both parties agree in writing. A home is let for at most 5 years at a time (s. 385).

3. 3. मासिक भाडा र भुक्तानी

   मासिक घर बहाल रकम रु. 1,20,000 (अक्षरेपी एक लाख बीस हजार रुपैयाँ मात्र) हुनेछ। बहालवालाले प्रत्येक महिनाको भाडा अर्को महिनाको 7 गतेभित्र बैंक खातामा जम्मा मार्फत घरधनीलाई बुझाउनेछ। घरधनीले हरेक भुक्तानीको भरपाई दिनेछ (दफा 391)।

   3. Monthly rent and payment

   The monthly rent is Rs. 1,20,000 (Rupees One Lakh Twenty Thousand only). The Tenant pays each month's rent by day 7 of the following BS month, by deposit to a bank account. The Landlord gives a receipt for every payment (s. 391).

4. 4. धरौटी

   यस सम्झौतामा कुनै धरौटी लिइएको छैन।

   4. Deposit

   No deposit is paid under this agreement.

5. 5. भाडा वृद्धि

   सम्झौता अवधिभर भाडा बढ्ने छैन। नवीकरण गर्दा नयाँ भाडा दुवै पक्षको सहमतिमा तय गरिनेछ।

   5. Rent increase

   The rent does not change during the term. Any new rent on renewal is agreed by both parties.

6. 6. बिजुली

   बिजुलीको खर्च बहालवालाले सब-मिटरअनुसार तिर्नेछ। सम्झौताको दिन सब-मिटरको रिडिङ ………………………… युनिट छ। प्रति युनिट नेपाल विद्युत प्राधिकरणको प्रचलित महसुल दरअनुसार हिसाब गरी मासिक भाडासँगै बुझाइनेछ।

   6. Electricity

   The Tenant pays for electricity by the sub-meter, which reads ………………………… units on the day of signing. It is charged at the Nepal Electricity Authority's current tariff and paid with the monthly rent.

7. 7. पानी, फोहोर र इन्टरनेट

   • खानेपानी: मासिक रु. …………………………, भाडासँगै बुझाइने।

   7. Water, waste and internet

   • Water: Rs. ………………………… a month, paid with the rent.

   • Internet: the Tenant's own connection, paid by the Tenant.
   • The Landlord provides water, electricity, drainage and sanitation (s. 389).

8. 8. मर्मत सम्भार

   घरको संरचना, छाना, चुहावट, पानीको पाइप र बिजुलीको वायरिङ जस्ता ठूला मर्मत घरधनीले गर्नेछ। बहालवालाको लापरबाहीले भएको क्षति र दैनिक प्रयोगका साना मर्मत (बल्ब, धारा, चुकुल आदि) बहालवालाले गर्नेछ। लिखित सूचना पाएर पनि घरधनीले आफ्नो जिम्माको मर्मत नगरेमा बहालवालाले 15 दिन अगावै लागत अनुमान दिई मर्मत गराउन र सो खर्च भाडाबाट कट्टा गर्न सक्नेछ (दफा 394)।

   8. Repairs

   The Landlord does major repairs: the structure, roof, leaks, water pipes and wiring. The Tenant pays for damage they cause and does small everyday repairs (bulbs, taps, latches and the like). If the Landlord does not make a repair that is theirs after written notice, the Tenant may give a written cost estimate 15 days ahead, have it done and deduct the cost from the rent (s. 394).

9. 9. प्रयोग सम्बन्धी शर्त

   • घर बसोबास प्रयोजनका लागि मात्र प्रयोग गरिनेछ; घरधनीको सहमति बिना प्रयोजन बदलिने छैन (दफा 397)।
   • घरधनीको लिखित सहमति बिना बहालवालाले घर वा त्यसको कुनै भाग अरूलाई बहालमा दिने छैन (दफा 395)।
   • घरधनीको लिखित सहमति बिना घरको बनावटमा फेरबदल गरिने छैन (दफा 396)।
   • घरधनीको सहमति बिना घरपालुवा जनावर राखिने छैन।
   • बहालवालाले घर सफा राख्नेछ, आफ्नै घर सरह हेरचाह गर्नेछ र छिमेकी वा अन्य बसोबास गर्नेलाई असुविधा दिने छैन (दफा 390)। घरधनीले बहालवालालाई अन्य बसोबास गर्नेबाट हुने हैरानीबाट जोगाउनेछ (दफा 389)।
   • घरधनीले पूर्वसूचना दिएर उचित समयमा घरको निरीक्षण गर्न सक्नेछ (दफा 399)।

   9. Use of the property

   • The property is used for residential purposes only; the use does not change without the Landlord's consent (s. 397).
   • The Tenant does not sublet the property or any part of it without the Landlord's written consent (s. 395).
   • Nothing in the building's structure is changed without the Landlord's written consent (s. 396).
   • No pets are kept without the Landlord's consent.
   • The Tenant keeps the property clean, looks after it as their own and does not disturb neighbours or other occupants (s. 390). The Landlord protects the Tenant from harassment by other occupants (s. 389).
   • The Landlord may inspect the property at a reasonable time after giving notice (s. 399).

10. 10. घर बहाल कर

    यस भाडामा स्थानीय तहले लगाउने घर बहाल कर घरधनीले कानुनबमोजिम बुझाउनेछ (दफा 392)।

    10. House rent tax

    The Landlord pays the house rent tax that the municipality charges on this rent, as the law requires (s. 392).

11. 11. सम्झौता अन्त्य र सूचना

    घर आफैंलाई चाहिएमा घरधनीले, र घर नचाहिएमा बहालवालाले, कम्तीमा 35 दिन अगावै लिखित सूचना दिई सम्झौता अन्त्य गर्न सक्नेछन् (दफा 400 र 401)। बहालवालाले तीन महिनासम्म भाडा नतिरेमा, घरमा गैरकानुनी काम गरेमा वा यस सम्झौताका शर्त उल्लङ्घन गरेमा घरधनीले कानुनबमोजिम घर खाली गराउन सक्नेछ। बहालवालाले सूचना नदिई घर छाडेमा सूचना अवधिको भाडा धरौटीबाट कट्टा गर्न सकिनेछ।

    11. Ending early and notice

    The Landlord, if they need the property for their own use, or the Tenant, if they no longer need it, may end this agreement early with at least 35 days' written notice (ss. 400 and 401). If the Tenant does not pay rent for three months, uses the property for anything illegal or breaks these terms, the Landlord may have it vacated as the law allows. If the Tenant leaves without notice, the rent for the notice period may be taken from the deposit.

12. 12. घर फिर्ता

    सम्झौता अन्त्य हुँदा बहालवालाले सबै बाँकी भाडा र बिल चुक्ता गरी, घर सफा गरी, साँचो र घरसँगै बुझेका सामान गनेर सामान्य टुटफुटबाहेक ठीक अवस्थामा घरधनीलाई फिर्ता बुझाउनेछ (दफा 403)।

    12. Handing back

    When the agreement ends, the Tenant settles all rent and bills, and hands back the property clean, with the keys and every item received with it in good order, normal wear and tear excepted (s. 403).

13. 13. अन्य

    यस सम्झौतामा कुनै परिवर्तन दुवै पक्षको लिखित सहमतिबाट मात्र हुनेछ (दफा 398)। यसमा उल्लेख नभएका कुरा मुलुकी देवानी संहिता, 2074 र प्रचलित कानुनबमोजिम हुनेछन्। विवाद भएमा आपसी छलफलबाट, नभए वडा कार्यालय वा स्थानीय तहको न्यायिक समितिमार्फत मेलमिलापबाट, र त्यसबाट पनि नभए अदालतमार्फत समाधान गरिनेछ।

    13. Other terms

    Any change to this agreement needs both parties' written consent (s. 398). Anything not covered here follows the Muluki Civil Code, 2074 and other laws in force. Disputes are settled by discussion, then by mediation at the ward office or the municipality's judicial committee, and failing that in court.
